These Terms and Conditions apply to all services provided by Eden Garden Maintenance & Design (Eden GMD). 

By accepting a quote, booking a job, requesting a service, continuing with ongoing appointments, or making payment, you agree to these terms.

Terms & Conditions

1. Scope of Work

All work will be agreed in advance via written or verbal communication. Any changes, additions, or unforeseen challenges may result in revised pricing.  Examples of additions or unforeseen challenges include (but are not limited to): discovering hidden tree stumps, unmarked underground pipework, significant garden overgrowth beyond what was initially quoted, or client requests for extra tasks on the day such as hedge trimming, waste removal, or planting.

 

2. Quotes & Estimates

Quotes are valid for 7 days from the date issued, unless otherwise specified on the quote.

All quotes are based on the information available at the time.
Prices for plants, materials, and third-party items are subject to change without notice, due to market fluctuations and supplier pricing. We will always notify you of any significant changes before proceeding.

 

3. Access Requirements

Clients are responsible for ensuring access to the property at the agreed date and time.
If we are unable to carry out the work due to lack of access or no one being home (where applicable), a cancellation fee of 50% of the quoted job cost will apply to cover lost time and expenses.

 

4. Cancellations & Rescheduling

Please provide at least two full working days' notice to cancel or reschedule a booking.
Late cancellations may be subject to a fee of up to 50% of the scheduled job value.  As a small team with a busy schedule, short-notice cancellations often mean we’re left with unused time that could have been offered to another client. We value your time — and we kindly ask the same in return.

 

5. Weather & Safety

In cases of extreme weather or unsafe working conditions, we may need to reschedule work at short notice. No fees will apply for delays caused by safety concerns.  We understand that genuine emergencies happen, and if you're unable to give the usual notice due to unexpected circumstances beyond your control, we’ll always aim to be flexible and fair.

5. Payment Terms

Invoices are due within 7 calendar days of issue, unless otherwise agreed.
Payment methods accepted: bank transfer (preferred), PayPal, or cash.

 

6. Late Fees & Charges

If payment is not received within 7 days of the invoice due date:

A late payment fee of £25 will be applied

If payment remains unpaid after a further 7 days (i.e., 14 days overdue):

An additional admin fee of £25 will be added to cover continued follow-up and processing
We reserve the right to begin recovery proceedings

From this point onwards, a daily fee of £2.00 per day will be added to the outstanding balance until the balance is paid in full or until the date of the court hearing, whichever comes first.  We reserve the right to begin recovery proceedings at any time after the 14-day overdue period.

 

7. Debt Recovery & Legal Action

If an invoice remains unpaid and we proceed to small claims court:

The court fees will be added to the debt
An additional admin fee of £40 will be charged for time spent preparing and filing the case

 

8. Refunds & Disputes

If you're not happy with the work completed, please contact us within 48 hours so we can resolve the issue quickly and fairly.

Where a full appointment has been carried out, labour costs will still be chargeable in full. However, if there's been a genuine concern with the outcome or service, we may offer a goodwill adjustment at our discretion.

 

9. Liability

We will take reasonable care while carrying out work. However, Eden GMD cannot be held responsible for:

Damage to underground cables, pipes, or hidden installations not clearly identified by the client in advance
Pre-existing structural issues or faults, including unstable fencing, loose paving, or rotten decking.


Damage caused by necessary access through narrow pathways, driveways, or garden structures unless explicitly discussed beforehand
Issues arising from weather conditions or natural wear and tear after our work is completed.  Any adverse reactions to pesticides, weed killers, or treatments if the client has not disclosed relevant sensitivities, allergies, or environmental concerns prior to use.

 

Clients are encouraged to discuss any known risks or special considerations before work begins.  This is not an exhaustive list, and Eden GMD cannot be held liable for any damage or issues where it is deemed that Eden GMD staff could not reasonably have known about the risk or prevented the outcome through normal duty of care.

All content on this website — including text, images, graphics, layout, logos, and design — is the property of Eden GMD unless otherwise stated.

The content is protected by copyright, trademark, and other intellectual property laws.  You may not copy, reproduce, modify, distribute, or use any content from this site for commercial purposes without prior written consent.  You are welcome to view, share, or reference our content for personal, non-commercial use, provided Eden GMD is clearly credited.

Our website may contain links to third-party websites for your convenience or additional information.  We are not responsible for the content, accuracy, or security of external sites linked from our website.  Inclusion of any external link does not imply endorsement or association.  You access third-party websites entirely at your own risk.

Privacy Policy

We take your privacy seriously. Any personal information you provide to Eden GMD — whether through contact forms, emails, or direct communication — is used solely for the purpose of responding to your enquiry, providing services, and managing our business relationship with you.

 

We do not sell, rent, or trade your personal information to third parties. Your details are kept secure and only accessible to team members who require them to perform their duties. Embedded Content
Our website includes an embedded Google Calendar to display our availability. This calendar is publicly viewable (no personal data is captured through Eden GMD). However, viewing the calendar may require you to be logged into a Google account, and according to Google’s policies, doing so may allow Google to collect data such as your IP address or device information.

By using this feature, you acknowledge and consent to Google’s data collection practices as outlined in their Privacy Policy. You can view or avoid using this feature by logging out of your Google account or choosing not to use it.
